Design patents: the hidden moat for products abroad
For consumer products, design patents are often more practical and faster than invention patents.
Many teams think 'invention patent' at the word patent and overlook design patents. For appearance-driven products — apparel, consumer electronics, home goods — design patents are often more practical.
A design patent protects a product's shape, pattern, and color combination; it is faster and cheaper to obtain, and directly powerful in anti-counterfeit enforcement, because knockoffs copy the appearance first.
The pragmatic approach is to file design patents for core appearances in target markets before launch, layering with trademarks and copyright.
